至于签订的劳务分包合同应该注意哪些问题?
第一,劳务分包合同的相对方要有劳务作业资质,这是劳务分包合同合法有效的前提。与没有劳务作业资质的实际施工人签订的劳务分包合同无效。
第二,要注意区分劳务分包和违法分包或工程转包。劳务分包是合法的,而非法分包和工程转包是违法的。
第三,签订劳务分包合同时一定要在合同里明确双方的权利和义务,尤其是安全生产的权利和义务。可以在劳务分包合同里约定由劳务分包人自己负责其施工队的生产安全,也即把劳务管理的内容加到劳务分包合同中来。
第四,如果要劳务承包人自己包料和机械设备,一定要以总承包人的名义与劳务分包人另外签订材料委托采购合同和机械设备租赁合同,否则就会出现名为劳务分包合同,实为违法分包合同或工程转包合同的情形,而后两者是违法的,是无效合同。
